As a pensions advisory partner in recovery and reorganisation, I specialise in providing covenant and affordability advice to trustees and employers. I’ve been with the firm since 2005 and have more than 25 years' experience in this area.
In addition to providing covenant advice in support of scheme valuation, I also advise on the impact on covenant of transactions, such as share and asset sales, refinancing, private equity transactions and clearance applications with the Pensions Regulator (TPR) and the Pension Protection Fund (PPF). This can be for single or multi-employer situations, solely in the UK or involving overseas ownership and listed companies.
Other work involves giving negotiation assistance and advice to trustees and companies with regard to affordability and mitigation, arising from transactions including the use of contingent assets.
I’ve also been involved in a number of substantial corporate and pension scheme restructurings involving scheme apportionment and PPF entry via Regulated Apportionment Arrangements. Major cases have included advising the PPF in the pension scheme debt-for-equity swap at Uniq plc and pension scheme trustees in the recent restructuring of UK Coal plc, where the scheme took a 75% stake in the property side of the business.
